In re Jefferson County, Alabama, Case No. 11-05736 (TBB)
United States Bankruptcy Court, Northern District of Alabama
General Information:
On November 9, 2011, Jefferson County, Alabama filed a voluntary petition for relief under Chapter 9 of the United States Bankruptcy Code (the "Bankruptcy Code"). The case was assigned Case No. 11-05736.
Pursuant to the Bankruptcy Code (specifically including, but not limited to, 11 U.S.C. §§ 362 and 922(a)), a debtor is afforded certain protection against its creditors; the Bankruptcy Code prohibits creditors from taking certain actions related to debts that may have been owing prior to the commencement of the Bankruptcy Case. If you believe that you might be a creditor of the County based upon debts arising prior to November 9, 2011 and you are considering taking action based upon your status as a creditor, you may wish to seek legal advice. The staff of the Clerk of the Bankruptcy Court and the staff of Kurtzman Carson Consultants LLC are not permitted to give legal advice.
On March 4, 2012, the Bankruptcy Court ruled that the County is eligible to be a debtor under Chapter 9 of the Bankruptcy Code. Accordingly, the Bankruptcy Court entered an order for relief, confirming that the County is eligible to file bankruptcy and is authorized to continue with its bankruptcy proceeding. The automatic stay that took effect when the bankruptcy petition was filed remains in effect. The County will continue to pursue the relief to which it is entitled under the Bankruptcy Code and applicable law, including a Chapter 9 plan of debt adjustment.
